State Constitutional Amendment
NYS were asked if they wanted to pass an amendment to the NYS constitution,
to change I.2 - to allow criminal defendants to waive the right to trial by jury, except in cases punishable by death
as proposed by the NYS Legislature
And the voters said: Yes!

The trial by jury in all cases in which it has been heretofore used shall remain inviolate forever; but a jury trial may be waived in the manner to be prescribed by law by the parties in all civil cases and by the defendant in all criminal cases, except those in which the crime charged may be punishable by death.…
