The Text

Vacancies occurring in the office of county judge, special county judge, surrogate, special surrogate, judge of a court of general sessions, or justice of the city court of the city of New York, shall be filled by appointment by the governor by and with the advice and consent of the senate if in session, or if not in session, by the governor. Such appointment shall continue until and including the last day of December next after the election at which the vacancy shall be filled. No temporary assignment of any such judge, justice or surrogate for service outside of his own court pursuant to the provisions of this article shall affect his existing office or create a vacancy therein.
